1. Acceptance of Terms
By accessing or using the FMD International website (www.fmdintl.com) or engaging our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our website or services. These terms are governed by the laws of the United Arab Emirates.
2. About Our Services
FMD International LLC provides commercial kitchen equipment, refrigeration systems, retail fit-out solutions, and equipment rental services to business customers (B2B) in the UAE and GCC region. Our website facilitates product browsing, enquiry submission, quotation requests, and account management. All sales are subject to separate written purchase agreements or confirmed quotations.
3. Eligibility
Our services are intended for business customers. By using this website you confirm that you are acting in a business or professional capacity and that you have the authority to bind your organisation to any orders or agreements made through this platform.
4. Product Information & Pricing
Product descriptions, specifications, and images are provided for informational purposes only. We reserve the right to correct any errors, inaccuracies, or omissions at any time without prior notice. Prices displayed on the website are indicative only. All confirmed pricing is subject to a formal written quotation issued by FMD International and may be subject to VAT and other applicable taxes.
5. Enquiries & Orders
Submitting an enquiry through our website or WhatsApp does not constitute a binding order. A contract for the supply of goods or services is formed only upon (a) receipt of a formal purchase order from you, and (b) written acceptance or issuance of a sales order confirmation by FMD International. FMD reserves the right to decline any order at its discretion.
6. Equipment Rental Terms
Equipment rental is subject to a separate Rental Agreement signed by both parties. Key general conditions include: (a) rental equipment remains the property of FMD International at all times; (b) the customer is responsible for safe use and care of the equipment; (c) damage beyond normal wear and tear will be charged to the customer at replacement cost; (d) FMD International reserves the right to inspect equipment at any time during the rental period with reasonable notice; (e) rental periods and rates are as agreed in the signed Rental Agreement.
7. Payment Terms
Payment terms are as specified in the applicable sales order, invoice, or rental agreement. Standard terms for new customers are 50% deposit upon order confirmation and 50% prior to delivery. Late payments may be subject to interest charges as permitted under UAE commercial law.
8. Warranty & Liability
New equipment is covered by the manufacturer's warranty as specified in the product documentation. FMD International provides installation and commissioning support as agreed. To the maximum extent permitted by UAE law, FMD International's liability for any claim arising from the supply of goods or services shall not exceed the value of the goods or services that gave rise to the claim. We are not liable for indirect, consequential, or special damages.
9. Intellectual Property
All content on this website including text, images, logos, and brand materials are the property of FMD International or are used with permission. You may not reproduce, distribute, or create derivative works without our prior written consent.
10. User Accounts
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use. We reserve the right to terminate accounts that violate these terms.
11. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates, specifically the laws applicable in the Emirate of Dubai. Any disputes arising from these Terms or the use of our services shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of our website after changes are posted constitutes your acceptance of the updated Terms.
